Terms of Service

SpecForm OS is a product operated by Mochic LTD (company no. 12405063) ("we", "us", "our"). By accessing or using SpecForm OS, you agree to these Terms. If you do not agree, you must not use the Service. These Terms incorporate our Privacy Policy and, for enterprise customers, our Data Processing Addendum (DPA).
1. The Service
SpecForm OS is an AI-native platform for technical fashion development - providing AI-assisted design, TechPack generation, BOM tooling, pattern logic, and production workflow tools. We may add, modify, or remove features over time.
AI-generated outputs may contain inaccuracies or manufacturing errors. Users are solely responsible for reviewing and validating all generated content before production. SpecForm OS does not guarantee manufacturability, grading accuracy, fit, costing, compliance, or production outcomes.
2. Eligibility and Accounts
You must be at least 16 years old and able to enter a binding contract. You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
3. Intellectual Property and Data Usage
User Content: You retain all ownership rights to designs, sketches, measurements, and data you upload.
Rights to uploads: You represent and warrant that you own, or hold all necessary rights and licences to, any image or content you upload, and that it does not infringe the intellectual-property or other rights of any third party. SpecForm OS is a technical tool and does not review or verify the licensing of uploaded content. You agree to indemnify and hold harmless Mochic LTD against any claim arising from content you upload.
Ownership of Generated Output: Upon successful payment, ownership of generated technical assets - including TechPacks, BOMs, and pattern logic - is assigned to you outright. You may use it for any purpose, including commercial production, with no further licence from us. Free-tier Output is licensed to you; full ownership transfers on payment.
Licence to Operate: You grant us a limited, non-exclusive licence to host, process, and display your content solely to provide, secure, and support the Service.
Model training and accuracy. To improve our fashion engineering models, we may use anonymised technical patterns from generated assets. This never includes proprietary brand identifiers, creative sketches, or personal information.
Free-plan users and model improvement. Where you use the free plan, anonymised technical patterns derived from your generated assets may be used to improve model accuracy. This is strictly limited to abstract construction and measurement logic - not your creative designs, sketches, brand identifiers, or any content that could be attributed to you. All users may opt out at any time via account settings or by emailing morchen@specform.pro. Paid subscribers are not subject to this use; their data is processed solely to deliver the Service.
AI provider restrictions. Our AI providers (Google and OpenAI) are contractually prohibited from using your submitted content - designs, sketches, prompts, or generated outputs - to train, fine-tune, or improve their own models. They process your data solely to generate your requested output.
SpecForm OS IP: The underlying AI models, software, algorithms, and platform remain the exclusive property of Mochic LTD. Ownership of your Output does not transfer any rights in our underlying technology.
4. Acceptable Use
You may not:
- Use the platform to generate infringing, unlawful, or harmful content.
- Use the Service, or any generated output, to copy, reproduce, reverse-engineer, recreate, or otherwise misappropriate the designs, patterns, trade dress, trademarks, or products of any third party.
- Attempt to reverse-engineer, scrape, or extract the SpecForm OS AI models or systems.
- Share credentials with unauthorised third parties or resell access without our written consent.
- Interfere with or attempt to gain unauthorised access to the Service or its infrastructure.
You are solely responsible for ensuring that your use of the Service, and any output you generate, does not infringe the intellectual-property or other rights of any third party. SpecForm OS is a technical tool and does not review, verify, or endorse how you use it. You agree to indemnify and hold harmless Mochic LTD against any claim arising from your breach of this section, and we may suspend or terminate accounts that violate it.
4A. Human Access to Creative Content
Our engineering and support staff do not access or review your uploaded creative content - including designs, sketches, measurement data, or generated outputs - as part of normal operations, quality control, or system maintenance.
Where support access to specific content is required to investigate a technical issue you have raised, this occurs only with your explicit consent and is subject to the same confidentiality obligations that apply to all personal data we hold.
5. Payment and Subscriptions
Subscriptions are billed in advance on a recurring basis via Stripe. We may change fees with reasonable prior notice; changes will not affect the current billing period already paid. Credits have no cash value, cannot be transferred, and may expire where stated.
6. Cancellation and Refunds
You may cancel at any time through your account settings. You retain access until the end of your current billing period.
14-day right to cancel (consumers): At checkout you expressly consent to immediate supply and acknowledge that the 14-day cancellation right no longer applies once generation/export begins.
Refunds: Fees are non-refundable once a TechPack has been generated or an export initiated, except where required by law. Contact morchen@specform.pro within 7 days of a billing error.
7. Availability and Changes
We aim to keep the Service available but do not guarantee uninterrupted access. We may suspend or modify features for maintenance, security, or operational reasons.
8. Disclaimers and Limitation of Liability
The Service is provided "as is". To the fullest extent permitted by law, we disclaim all implied warranties. Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the event. Nothing excludes liability that cannot be excluded under law.
9. Governing Law
These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
